Обеспечение конфиденциальности информации в Узбекистане

In an age built on information technology, the confidentiality of data carries particular weight. Confidential information is an asset that requires protection from unauthorised access. In Uzbekistan the right to personal confidential information is guaranteed not only by the Constitution but also by a number of legislative acts, which reflects how important data confidentiality has become in modern society.

In business, alongside personal data, trade secrets, know-how and other confidential company information carry enormous value. Such data matters most in science, technology, manufacturing, finance and similar fields, and it is especially critical in highly competitive sectors where innovation and proprietary methods are decisive. Protecting it is an inseparable part of corporate strategy: it secures a competitive advantage and provides resilience in shifting market conditions. Keeping company secrets is a key element of long-term success and of a firm position in the market.

Under Uzbek law, a trade secret is information of high commercial value in scientific, technical, technological, production or financial and economic fields. Such information remains unknown to third parties and is subject to specific protection against unauthorised disclosure.

Having employees sign a non-disclosure agreement is an essential step towards confidentiality, but on its own it is not enough. A company needs to develop and implement a set of corporate documents designed to prevent leaks and to protect its trade secrets reliably.

It is worth noting that not all information qualifies as a trade secret under Uzbek law. The criteria are clearly set out, which gives companies a clear understanding of which data requires additional protection.

Measures for protecting a trade secret include defining the list and the scope of the information concerned, establishing the procedure for handling it and for monitoring compliance with that procedure, and keeping a record of the persons granted access. Specific markings must also be applied to the physical media and the documentation containing the trade secret.

In commercial relationships, the contracting parties are required to state expressly the nature and the list of information constituting a trade secret, together with their mutual obligations to safeguard it.
